The irreversibility effect implies that a decision maker who neglects the prospect of receiving more complete information at later stages of a sequential decision problem will in certain cases too easily take an irreversible decision, as he ignores the existence of a positive option value in favour of reversible decisions. This option value represents the decision maker's flexibility to adapt subsequent decisions to the obtained information. In this paper we show that the economic models dealing with irreversibility as used in (...) environmental and capital investment decision making can be extended to emergency response decisions that produce important irreversible effects. In particular, we concentrate on the decision whether or not to evacuate an industrial area threatened by a possible nuclear accident. We show in a simple two-period evacuation decision model that non-optimal conclusions may be drawn when evacuation is regarded as a `now or never decision'. The robustness of these results is verified by means of a sensitivity analysis of the various model parameters. Prescriptive rules guide human behavior across various domains of community life, including law, morality, and etiquette. What, specifically, are rules in the eyes of their subjects, i.e., those who are expected to abide by them? Over the last sixty years, theorists in the philosophy of law have offered a useful framework with which to consider this question. Some, following H. L. A. Hart, argue that a rule’s text at least sometimes suffices to determine whether the rule itself covers a case. (...) Others, in the spirit of Lon Fuller, believe that there is no way to understand a rule without invoking its purpose — the benevolent ends which it is meant to advance. In this paper we ask whether people associate rules with their textual formulation or their underlying purpose. We find that both text and purpose guide people’s reasoning about the scope of a rule. Overall, a rule’s text more strongly contributed to rule infraction decisions than did its purpose. The balance of these considerations, however, varied across experimental conditions: In conditions favoring a spontaneous judgment, rule interpretation was affected by moral purposes, whereas analytic conditions resulted in a greater adherence to textual interpretations. In sum, our findings suggest that the philosophical debate between textualism and purposivism partly reflects two broader approaches to normative reasoning that vary within and across individuals. Higher courts sometimes assess the constitutionality of law by working through a concrete case, other times by reasoning about the underlying question in a more abstract way. Prior research has found that the degree of concreteness or abstraction with which an issue is formulated can influence people's prescriptive views: For instance, people often endorse punishment for concrete misdeeds that they would oppose if the circumstances were described abstractly. We sought to understand whether the so-called ‘abstract/concrete paradox’ also jeopardizes the consistency (...) of judicial reasoning. In a series of experiments, both lay and professional judges sometimes reached opposite conclusions when reasoning about concrete cases versus the underlying issues formulated in abstract terms. This effect emerged whether participants reasoned with broad principles, such as human dignity, or narrow rules, and was largest among individuals high in trait empathy. Finally, to understand whether people reflectively endorse the discrepancy between abstract and concrete resolutions, we examined their reactions when evaluating both, either simultaneously or sequentially. These approaches revealed no single pattern across lay and expert populations, or exploratory and confirmatory studies. Taken together, our studies suggest that empathic concern plays a greater role in guiding the judicial resolution of concrete cases than in illuminating judges' professed standards—which may result in concrete decisions in violation of their own abstract principles. Ses écrits, publiés ou inédits, opposent régulièrement « la nouveauté du christianisme » – comme expérience de l’homme, comme attitude religieuse, et jusque dans sa conception de Dieu – à une théologie dite « explicative », qui ne parviendrait pas à penser cette nouveauté, voire la trahirait. Accusée d’importer le Dieu des philosophes, cette théologie expliquerait Dieu et expliquerait par Dieu pour mieux se passer des mystères de l’homme, (...) des dimensions tragiques de sa condition, manquant ainsi paradoxalement une négativité qui est le lieu même où s’ouvre l’attitude religieuse. Dans cette confrontation originale, Merleau-Ponty transpose sa propre lutte contre certains philosophes et mobilise les axes essentiels de sa pensée : ses conceptions de l’homme et de l’être, une anthropologie de la chair perceptive et désirante, une ontologie de l’être inachevé et inépuisable. Merleau-Ponty was always interested in the complex relationship between christianity, philosophy and theology. His writings, published or unpublished, regularly contrast « the novelty of Christianity » — as experience of man, as religious attitude, and including its conception of God — with a so-called « explanatory » theology, which would not manage to think this novelty, might even betray it. Charged with importing the God of the philosophers, this theology would explain God and explain by God in order to bypass the mysteries of man, the tragic dimensions of its condition, thus paradoxically missing a negativity which is the very place where the religious attitude unfolds. In this original confrontation, Merleau-Ponty transposes his own fight against some philosophers and summons the essential axis of his thought : his conceptions of man and being, an anthropology of perceptive and desiring flesh, an ontology of unfinished and inexhaustible being. There has been considerable debate in legal philosophy about how to attribute purposes to rules. Separately, within cognitive science, there has been a growing body of research concerned with questions about how people ordinarily attribute purposes. Here, we argue that these two separate fields might be connected by experimental jurisprudence. Across four studies, we find evidence for the claim that people use the same criteria to attribute purposes to physical objects and to rules. In both cases, purpose attributions appear to (...) be governed not so much by original intention or by moral value as by current practice. We argue that these findings in the cognitive science of purpose attribution have implications for jurisprudential questions involving purposivist legal interpretation. (shrink)

Several aspects differentiate Young’s view from what could be called a classic conception of responsibility. This special issue gathers four articles that show Young’s innovative conception of responsibility. Pendant cette phase de transition indispensable à la compréhension de la genèse des derniers écrits, Merleau-Ponty commence à se libérer des concepts classiques pour s'acheminer vers deux éléments capitaux de sa pensée: la chair et l'empiétement. A partir du bilan moral et politique de 1945, il fait de l'empiétement une figure de la modernité, et travaille en lui l'alliance singulière de pessimisme et d'optimisme (...) par laquelle il veut traduire sa propre version de l'existentialisme. Dans une complicité significative avec l'onirisme des " psychanalyses " de Bachelard, de la " co-naissance " de Claudel et de l'" amour fou " de Breton, Merleau-Ponty prépare ses propres éléments ontologiques, aux antipodes de l'imaginaire sartrien. Nous étudions ici l’une des figures les plus originales et les plus complexes de l’univers du dernier Merleau-Ponty, l’une des moins bien comprises aussi : la « promiscuité ». Aussi polymorphe que la célèbre figure de l’«empiétement », la «promiscuité » appartient en propre au complexe de la psychanalyse ontologique de Merleau-Ponty. Elle décrit d’abord la logique des rapports archaïques avec autrui, et se situe en cela dans la ligne du travail sur l’intercorporéité. Elle désigne aussi la modalité connaissante de (...) la chair, tout en indiquant notre résistance à celle-ci, notre ignorance naturelle de la chair comme être de promiscuité. Elle habite bientôt le cœur de la conception merleau-pontienne de l’inconscient, dans le prolongement des travaux de Paul Schilder sur l’image du corps. Enfin, elle vient renouveler dans les derniers manuscrits l’idée même de mystère ontologique. La chair, être de promiscuité, vit dans la promiscuité de l’être. Et la philosophie, d’après Merleau-Ponty, devrait être le savoir cohérent des visages apparemment si divers de cette ultime figure du lien. (shrink)

This thinking stems from both a clinical and philosophicalbackground that explores the carnal (fleshly) foundation of desire. From a phenomenologyin dialogue with psychology, psychoanalysis and philosophy of education, the concept oflift addresses the very foundations of our openness to the world and to others.

Interwoven with natural structurations and personal history, the flesh , in Merleau-Ponty's gradually-forged conception, is nourished by the combined influences of neurology, Gestalt psychology and psychoanalysis. This triple influence undergirds a recurring theme in his later writings: the mirror . "The flesh is a mirror phenomenon," Merleau-Ponty tells us. The unpublished manuscripts reveal that this famous clause refers neither directly to Husserl, nor to Wallon and Lacan, but is driven by contemporary readings of Paul Schilder and Wolfgang Metzger, who study (...) the phenomena of distanciated migrations of the body-image in vision. The mirror mingles objective body with phenomenal body, in an effective community between my lived body and its external image. It shows how the flesh lives both within and outside of itself, animated by an essential incompleteness that engages perception in a process of incorporation and, thus, hints at intercorporeity. The academic journal publishing model is deeply unethical: today, a few major, for-profit conglomerates control more than 50 of all articles in the natural sciences and social sciences, driving subscription and open-access publishing fees above levels that can be sustainably maintained by publicly funded universities, libraries, and research institutions worldwide. About a third of the costs paid for publishing papers is profit for these dominant publishers' shareholders, and about half of them covers costs to keep the system running, including lobbying, (...) marketing fees, and paywalls. The paywalls in turn restrict access of scientific outputs, preventing them from being freely shared with the public and other researchers. Thus, money that the public is told goes into science is actually being funneled away from it, or used to limit access to it. Alternatives to this model exist and have increased in popularity in recent years, including diamond open-access journals and community-driven recommendation models. These are free of charge for authors and minimize costs for institutions and agencies, while making peer-reviewed scientific results publicly accessible. However, for-profit publishing agents have made change difficult, by co-opting open-access schemes and creating journal-driven incentives that prevent an effective collective transition away from profiteering. Here, we give a brief overview of the current state of the academic publishing system, including its most important systemic problems. We then describe alternative systems. We explain the reasons why the move toward them can be perceived as costly to individual researchers, and we demystify common roadblocks to change. Finally, in view of the above, we provide a set of guidelines and recommendations that academics at all levels can implement, in order to enable a more rapid and effective transition toward ethical publishing. A cross-cultural survey experiment revealed a widespread tendency to rely on a rule’s letter over its spirit when deciding which acts violate the rule. This tendency’s strength varied markedly across (k = 15) field sites, owing to cultural variation in the impact of moral appraisals on judgments of rule violation. Compared to laypeople, legal experts were more inclined to disregard their moral evaluations of the acts altogether, and consequently exhibited more pronounced textualist tendencies. Finally, we evaluated a plausible mechanism for (...) the emergence of textualism: In a two-player coordination game, incentives to coordinate in the absence of communication reinforced participants’ adherence to rules’ literal meaning. Together, these studies (Ntotal = 5495) help clarify the origins and allure of textualism, especially in the law. Within heterogeneous communities in which members diverge in their moral appraisals involving a rule’s purpose, the rule’s literal meaning provides a clear focal point—an easily identifiable point of agreement enabling coordinated interpretation among citizens, lawmakers and judges.
